علی اکبر بختیاری، مدیر حوزه ریاست دیوان عدالت اداری روز سه شنبه دوم خرداد در گفتگو با خبر گزاری فارس گفت: "آنچه رای می گوید ابطال نامه هیئت نظارت وزارت ارشاد است و طبیعتا وقتی این موضوع نقض می شود همه چیز به وضعیت قبل باز می گردد."

به گفته آقای بختیاری شعبه رسیدگی کننده به پرونده به یکی از مسائل موجود در حکم وزارت ارشاد اشکال گرفته است.

مدیر حوزه ریاست دیوان عدالت ادارای در جواب این سوال که آیا خانه سینما می تواند دوباره به فعالیت خود ادامه دهد گفت: "خانه سینما قبل از انحلال هر وضعیتی که داشته الان هم به همان وضعیت برمی گردد."

همزمان محمدجعفر منتظری، رئیس دیوان عدالت اداری نیز در گفتگو با خبرگزاری دانشجویان ایران (ایسنا) با تایید نقض تصمیم وزارت ارشاد درباره انحلال خانه سینما گفت که وزارت ارشاد باید مجددا در موضوع انحلال خانه سینما تصمیم گیری کند.

خانه سینما در واکنش به این حکم، با انتشار متنی با تبریک به اهالی خانه سینما از "اعتقاد این خانه به بهره گیری از ظرفیت های قانونی برای حل مشکلات" تاکید کرد.

در ادامه این نامه با تشکر از دیوان عدالت اداری برای رفع سو تفاهمات، اعلام شده است که خانه سینما فعالیت خود را از روز سوم خرداد آغاز خواهد کرد.

علیرضا سجادپور، مدیر کل نظارت و ارزشیابی وزارت ارشاد هم در گفت و گو با ایسنا با اشاره به اینکه دیوان عدالت اداری تنها یک "اشکال شکلی" به حکم گرفته است گفت که "بدیهی است که با رفع اشکال حکم انحلال همچنان به قوت خود باقی است."

او با اشاره به اینکه معاونت حقوقی وزارت ارشاد در حال تهیه جوابیه ای است گفت که از نظر این وزارت خانه، "تعطیلی خانه سینما همچنان برقرار و قطعی است."

علی اکبر مسعودپور، معاون حقوقی و امور مجلس وزارت فرهنگ و ارشاد هم در توضیح ایرادی که دیوان عدالت اداری به رای این وزارتخانه برای انحلال خانه سینما گرفته گفت: "دیوان عدالت اداری در نامه خود به وزارت ارشاد این نکته را آورده است که اصولا شکل گیری خانه سینما وجاهت قانونی نداشته و لذا دلیلی نیز برای منحل کردن آن از سوی وزارت ارشاد وجود ندارد."

به گزارش خبرگزاری مهر، معاون حقوقی و امور مجلس وزارت ارشاد با بیان اینکه ایراد دیوان عدالت اداری به رای انحلال خانه سینما "جزئی" است، خبر نقض این رای از سوی دیوان عدالت اداری را تکذیب کرد.

وزارت ارشاد روز دوشنبه ۱۳ دی ماه سال گذشته با ارسال نامه ای که خبرگزاریها تصاویرش را منتشر کردند فعالیت های خانه سینما را "فاقد وجاهت قانونی" خواند و از دست اندرکاران این نهاد خواست که ظرف مدت ۴۸ ساعت کلیه فعالیت های خود را "متوقف" کنند.

در نامه وزارت فرهنگ و ارشاد به خانه سینما آمده بود: "بدینوسیله اعلام می دارد با توجه به عدم طی تشریفات قانونی مربوط به تاسیس موسسات فرهنگی و هنری و نیز اقدامات غیر قانونی بعدی، این تشکل و استمرار فعالیت های آن فاقد وجاهت قانونی است و مراتب جهت انحلال خانه سینما اعلام می گردد."

وزیر ارشاد هم بی توجهی مسئولان خانه سینما به حکم انحلال خانه سینما از سوی وزارت ارشاد را "کلاهبرداری" خوانده بود.

محمدمهدی عسگر پور، مدیر عامل خانه سینما در واکنش به نامه ارسالی این وزارتخانه درباره انحلال خانه سینما آن را "فاقد مبنای قانونی" دانسته و گفته بود که منتظر تشکیل دادگاه می ماند.

معاونت امور سینمایی وزارت فرهنگ و ارشاد پیشتر از تشکیل یک "کمیته ساماندهی موقتی برای اداره امور صنفی اصناف سینمایی" در ایران، خبر داده بود که جایگزین خانه سینما می شود.

خانه سینما بزرگترین نهاد صنفی سینمایی ایران است که اندیشه تاسیس آن از اواخر دهه شصت شمسی آغاز شد و در سال ۷۲ رسما با این عنوان در اداره کل ثبت شرکت ها به ثبت رسید.
